The Chemical Weapons (Convention) Ordinance (Cap. 578) empowers the Director-General of Trade and Industry ("the Director") to operate a Permit System with a view to implementing the requirements under the Ordinance. Section 8 specifies when a permit is required. It stipulates that operator of a facility requires a permit to operate the facility during a particular year if the facility produced, acquired, retained, processed, consumed, used or transferred scheduled chemicals exceeding the specified limit.
Section 9 provides that an application for a permit needs to be made in the specified form and accompanied by a fee to the Director.
Section 10 provides that the Director may grant a permit subject to conditions or may refuse to grant a permit.
