Reports on Changes and Additionally Planned Activities

A permit holder must report to the Director-General of Trade and Industry ("the Director") any changes regarding the information previously submitted to the Director including those provided in the permit application, anticipated reports submitted as well as any other information provided upon the Director's request. Any additionally planned activities which will take place at the facility must receive prior approval from the Director.

Detailed requirement for changes related to Schedule 1, 2 and 3 facilities are respectively provided as follows:

Schedule 1 Chemicals (pdf format)

A permit holder who has been granted a permit to operate a Schedule 1 facility must seek prior approval from the Director concerning any changes to the permit particulars and any additionally planned activities which will take place at the facility.

Such changes should be reported to the Director by completing the amendment form (pdf format) and resubmitting the relevant reports containing the updated information (i.e. Form P-1, S1 and S1-3 as appropriate). The amendment request must be made in advance and should reach the Director in writing not less than 220 calendar days before the commencement of such changes.

Schedule 2 Chemicals (pdf format)

A permit holder who has been granted a permit to operate a Schedule 2 facility must seek prior approval from the Director if there are changes to the permit particulars and/or if any of the following activities are additionally planned in the year to which the annual anticipated reports submitted relate -

  1. a previously undeclared plant of the facility will produce, process or consume a Schedule 2 chemical above the applicable reporting threshold;

  2. an additional Schedule 2 chemical will be produced, processed or consumed at a declared plant in an amount in excess of the applicable reporting threshold;

  3. an additional activity (production, processing, consumption, transfer or export) related to a previously declared Schedule 2 chemical will be carried out at the declared plant above the applicable reporting threshold;

  4. an increase in production, processing or consumption of a Schedule 2 chemical by a declared plant;

  5. a change in the start or end date of the previously declared anticipated production, processing or consumption by more than three months; and/or

  6. an increase in the declared anticipated annual production, processing or consumption figure for a Schedule 2 chemical.

The changes should be reported to the Director by completing the amendment form (pdf format) and resubmitting the relevant reports containing the updated information (i.e. Form P-1, S2-3 and S2-4 as appropriate). The amendment request should reach the Director not less than 21 calendar days before the commencement of the additionally planned activity or any other changes.

Schedule 3 Chemicals (pdf format)

A permit holder who has been granted a permit to operate a Schedule 3 facility must seek prior approval from the Director if there are changes to the permit particulars and/or if any of the following activities are additionally planned in the year to which the annual anticipated reports submitted relate -

  1. a previously undeclared plant in the facility will produce a Schedule 3 chemical above 30 tonnes;

  2. a declared plant will produce an additional Schedule 3 chemical above 30 tonnes;

  3. a change in the purpose for producing Schedule 3 chemical(s) at the facility; and/or

  4. an increase in the amount of production of Schedule 3 chemical(s) at a facility.

The changes should be reported to the Director by completing the amendment form (pdf format) and resubmitting the relevant reports containing the updated information (i.e. Form P-1 and Form S3-2 as appropriate). The amendment request should reach the Director not less than 21 calendar days before the commencement of the additionally planned activity or any other changes.
